Noxious Weed Management Requirements for Development

Preliminary Plat Review

Prior to construction or disturbance, a Noxious Weed Management Plan and supporting documents must be submitted by the Landowner to the Weed District.  The complete application must include the following:

  • Cover letter outlining the current and future uses of the property.
  • Completed Subdivision Weed Management Plan.
  • Plat map detailing the species and distribution of Noxious Weeds present.
  • If hiring a contractor, a copy of the written contract between the contractor and Landowner.
  • Review fee: $150 for Minor (1-5 lots) or $300 for Major (6 or more lots).

The Weed District representative will inspect the property and approve, reject, or approve the Plan with recommendations and/or conditions. The signed Weed Management Plan constitutes a binding agreement between the Weed Board and the Landowner (MCA 7-22-2152).  **By signing the Weed Management Plan, the Landowner agrees to follow through with all of the weed control measures outlined in the Plan**.

Final Plat Approval

Prior to final plat approval of any phase of the subdivision, the Landowner shall enter into a Memorandum of Understanding with the Weed District. The property, prior to final plat approval, shall be sufficiently controlled for noxious weeds and areas disturbed sufficiently re-vegetated, as was outlined in the original Weed Management Plan.  The application for Memorandum of Understanding must include the following:

  • Completed Memorandum of Understanding signed by the Landowner.
  • Documentation demonstrating that the Weed Management Plan has been effectively implemented for each year that the Plan was valid.  Click here for a complete list of information that must be included with the application.**Failure to provide evidence that the Weed Management Plan has been implemented will result in denial of the Memorandum of Understanding**.
  • A copy of the subdivision covenants required by Gallatin County regarding Noxious Weed management (see table at top of page). The section regarding Noxious Weed management must be highlighted.

Preliminary Plat Extension

The Weed District requires the following documentation when approving subdivision Noxious Weed Management Plan Extensions: 

  • Cover letter explaining Landowner’s intentions for the property and why the extension is necessary.
  • New completed 3 or 5 year Weed Management Plan Extension.
  • Plat map detailing species and distribution of Noxious Weeds present.
  • Documentation demonstrating that the previous Weed Management Plan has been effectively implemented for each year that the Plan was valid. Click here for a complete list of information that must be included with the application.**Failure to provide evidence that the Weed Management Plan has been implemented will result in denial of the Extension**.
  • If hiring a contractor, a copy of the written contract between the contractor and Landowner.

Buildings for Lease or Rent

The Weed District requires the following documentation when approving Building for Lease or Rent Weed Management Plans: 

  • Cover letter explaining Landowner’s intentions for the property.
  • Completed Weed Management Plan.
  • Map detailing location of property that also includes species and distribution of Noxious Weeds present.
  • If hiring a contractor to perform weed control, a copy of the written contract between the contractor and Landowner.
  • Review fee: $150 for Minor (1-5 buildings) or $300 for Major (6 or more buildings).
